CUSTOMER AGREEMENT

This Customer Agreement (“Agreement”) is entered into between Traction LLC, doing business as High School Taskers (“Taskers”, “we”, “us”, or “our”), and you, the customer (“Customer,” “you,” or “your”). By creating an account, booking, or using our platform, you agree to the following terms:

1. How It Works

High School Taskers is a community-focused Marketplace Platform that connects families within a school district with vetted high school students who provide household services (“Services”).

Each participating school or municipality has its own custom-branded Taskers site and mobile app. Families create an account, browse available Services, and hire students to complete tasks at their home or property.

Educational Commitment:
In addition to facilitating these Services, Taskers provides a real-world small business incubator. We host 30-minute workshops twice a month with the Taskers participating in each Service offered on the High Schools Tasker app. In these Workshops we introduce students to Marketing and Financial Analytics, as well as discuss customer service, operations, and financial literacy — empowering students to launch, build, and grow their own local businesses. The workshops are not mandatory for the Taskers, we understand they have many responsibilities including their academics, sports and club obligations and family responsibilities. 

2. Payment Processing

Taskers collects 100% of the booking fee through its secure online payment gateway at the time of scheduling. Students are independent contractors, not employees of Taskers or the participating school. After retaining a service fee to cover operations and program costs, Taskers pays each student 75% of the gross revenue earned from their completed Services. Any tips paid through the platform go entirely to the student.

3. Marketplace & Independent Contractor Role

All students providing Services through Taskers are independent contractors. Neither Traction LLC nor the participating High School is the employer, supervisor, or manager of any student you hire. You agree to hire students at your own risk and provide a safe environment for Services to be performed.

Taskers operates solely as a Marketplace and payment processor and does not control or guarantee the work performed by students. We do not provide insurance coverage for student contractors. You are responsible for verifying whether your homeowners’ or general liability insurance covers Services performed by a student contractor on your property.

4. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless:
- Traction LLC, its owners, managers, officers, employees, agents, and affiliates; and
- The participating High School, its governing school district, board members, administrators, employees, teachers, staff, and volunteers;
from any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
1. Services performed by a student you hire through the Marketplace;
2. Any bodily injury, property damage, or other harm that occurs while Services are performed on your premises;
3. Your failure to provide a safe environment for Services to be performed;
4. Your negligence, misconduct, or breach of this Agreement; or
5. Any violation of applicable law.

5. Insurance

You acknowledge that you are solely responsible for maintaining any appropriate homeowners’ or general liability insurance to cover tasks performed by student contractors on your premises.

6. Cancellation Policy

To ensure optimal service and availability for all our clients, we kindly request that you provide us with a minimum of 24 hours’ notice for any appointment cancellations.

- If a cancellation is made with at least 24 hours’ notice, you will receive a full refund of the Services Fee.
- If a cancellation is made with less than 24 hours’ notice, you will be refunded 75% of the Services Fee.
- If a student arrives at your premises and is unable to perform the Service due to your absence or unsafe conditions, you may be charged up to 100% of the scheduled Services Fee.
- Taskers reserves the right to reschedule or cancel Services due to weather, safety concerns, or other unforeseen circumstances. In such cases, you will receive a full refund for any prepaid Services not completed.

7. Limitation of Liability

To the maximum extent permitted by law, the total liability of Traction LLC, its affiliates, and the participating High School for any claim under this Agreement shall not exceed the total fees paid by you for the specific Service giving rise to the claim.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.

9. Entire Agreement

This Agreement constitutes the entire understanding between you and Taskers regarding the subject matter herein and supersedes all prior or contemporaneous communications or agreements.

10. No Circumvention

You acknowledge and agree that all student contractors engaged through the High School Taskers Marketplace must be booked and paid for exclusively through the Taskers platform.

Families are strictly prohibited from attempting to enter into any separate or direct arrangement with a student contractor for additional services outside the Taskers platform at any time, including after the completion of a paid task.

Any attempt to circumvent Taskers by hiring students directly is a material breach of this Agreement and may result in:
- Immediate termination of your Customer account;
- Legal action to recover any lost revenue; and
- Indemnification for any resulting claims, costs, or damages.

11. Acceptance of Terms

By creating an account, booking Services, or using the High School Taskers Marketplace Platform, you acknowledge that you have read, understand, and agree to be bound by this Customer Agreement, including all sections related to the Marketplace role, payment processing, indemnification, cancellation policy, and the prohibition on circumventing the platform.
